1. Who we are
These terms govern your use of Kindly Days, our online planning tool for early-years practitioners (“the Service”), available at kindlydays.com and app.kindlydays.com.
2. The Service
Kindly Days provides planning tools, an activity library and related resources for early-years settings. The Service supports professional practice; it does not replace your professional judgement and is not staffing, safeguarding, SEND, medical or legal advice.
3. Account
You need an account to use the Service. Keep your login details safe; you are responsible for activity under your account. One personal plan covers one practitioner; the whole-setting licence covers the practitioners of one setting.
4. Plans, prices and free trial
- Monthly — £7.90 per month, renews monthly, no free trial.
- Annual, paid monthly — £5.90 per month with a fixed term of 12 monthly payments, including a 7-day free trial.
- Annual, one payment — £59.90 per year, renews yearly, including a 7-day free trial.
- Whole setting — £199 per year for one setting with unlimited practitioners, renews yearly, including a 7-day free trial. Payment by invoice is available for this plan.
All prices include VAT where applicable. Where a free trial is included, no payment is taken before the trial ends; you can cancel during the trial at no cost.
5. Term, renewal and cancellation
Monthly plans renew each month and can be cancelled at any time with effect from the end of the current billing period. The annual plan with one payment and the whole-setting licence renew yearly; they can be cancelled at any time with effect from the end of the paid year.
The annual plan paid monthly runs for a fixed term of 12 monthly payments and cannot be cancelled early; after the 12th payment it can be cancelled at any time with effect from the end of the current billing period. Statutory rights to terminate for good cause remain unaffected.
After cancellation, your access to the app remains active until the end of the paid period.
6. Right of withdrawal for consumers
If you order as a consumer, you have a statutory right to withdraw from the contract within 14 days without giving any reason. To exercise it, notify us by a clear statement (e.g. e-mail to support@kindlydays.com) before the withdrawal period ends.
Note on digital content: if you request immediate access to the Service during the withdrawal period and expressly acknowledge that you thereby lose your right of withdrawal upon full performance, the right of withdrawal expires accordingly. Where the Service has been partly performed, a proportionate amount may be payable.
7. Payment
Payment is taken by the payment method chosen at checkout (card and popular wallets via our payment provider; PayPal where offered). The whole-setting licence can also be paid by invoice: the yearly invoice is issued after the free trial and on each renewal, payable by bank transfer within 14 days of the invoice date.
8. Fair use and content
Content in Kindly Days (activities, texts, illustrations) is protected by copyright. You may use it within your own setting as part of the Service. Reselling, redistributing or systematically extracting content is not permitted.
9. Availability and changes
We continuously develop the Service and aim for high availability, without guaranteeing uninterrupted access. We may improve or change features, provided the core character of the Service is preserved.
10. Liability
We are liable without limitation for intent and gross negligence and under mandatory statutory provisions. For slight negligence we are liable only for breaches of essential contractual obligations, limited to the foreseeable damage typical of the contract.
11. Final provisions
German law applies; if you are a consumer, the mandatory consumer-protection provisions of your country of habitual residence remain unaffected. Should individual provisions be invalid, the remainder stays in force.
